The purpose of the website located at www.BEREALNG.com (the “Site”) is to present to the public the activities of BE REAL PROPERTIES and its subsidiaries, the range of services offered and to promote them. This Site also aims at providing users with both commercial and residential listings by replying to listings offers or submit spontaneous requests. Any user is invited to read the present general terms & conditions (the “Terms of Use”) carefully, considering that access and/or use of the Site is regarded as an express acceptance of the Term of Use.

The Terms of Use define the terms and conditions of use & consultation of the Site, its contents, its related services and the authorized use by the User.
The Terms of Use must be accepted by any User who access the Site. The access and/or the use of the Site implies unreserved acceptance of the present Terms of Use.
The BE REAL PROPERTIES LTD, owner of the website, reserves the right to change unilaterally without notice the present Terms of Use.

Publication of the Site is provided by BE REAL PROPERTIES LTD which head office is located at Victoria Island, Lagos, Nigeria.
The Site is hosted by Squarespace, a company incorporated in 2020.

Access to services

The Site offers the User a free access to the following services:

• information articles and serviced about BE REAL PROPERTIES LTD & its blog DARE LAGOS,

• commercial and residential listings.

Access to the Site and its services are free.

The Site makes its best efforts to ensure a high-quality access to it or its services but cannot guarantee to reach such result. The Site cannot be held responsible should a force majeure event occurs such as a disturbance /malfunction of the network or of the servers. Access to the Site or to its services might, at any moment, be subject to unlimited interruption, suspension, modification without notice resulting from maintenance operation or any other cause. The User agree not to be entitled to claim compensation because of interruption, suspension or modification of the Site or the proposed services.

GENERAL TERMS & CONDITIONS

Commercial Terms & Conditions

Agency fees are: 10% on total rent paid for 1 year — 7.5% on total rent paid for 2 years and above.
For your own comfort, we highly recommend a 48/72 hour notice to plan viewings which will take place from Tuesdays to Thursdays and Saturdays from 9 am to 2 pm due to traffic conditions. We can organise exceptional viewings during week end or public holidays at the Landlord’s discretion.

When you agree with our terms & conditions

> Based on your needs, Be Real team will check its listing database, select a list of properties and e-mail the list that we believe can match your requirements
> After checking the list, the client will select the properties he/she would like to visit
> Viewings will be organized and scheduled by Be Real team
> If a property is selected by the client, we will raise a list of items that need to be repaired, fixed, arranged and discussed with the Landlord before we send a commercial offer letter
> Once all parties agree on the requirements, Be Real team will send an offer letter stating all the commercial terms and conditions
> Once the offer letter is approved by the client, Be Real will liaise with the Landlords and check all the documents sent by his office (Draft Lease Agreement, Service Charges, Legal Fee) before sending them to the client
> Once all paperwork is in order (payment made and lease agreement signed), Be Real will assist during the handover of the apartment organised by the facility management company and will coordinate that all the items raised during the viewings have been attended to
> Be Real team is at your disposal for a duration of 6 months after the lease commencement date
> Our real estate services do not include facility management services. However, we will provide our professional opinion in this matter but cannot be held liable or responsible if any challenges are encountered.

Intellectual Property

All trademarks, logos, signs and other content of the Site are protected by law on intellectual property and more specifically by copyright.
The User must imperatively request prior written authorization of BE REAL PROPERTIES LTD for any reproduction, publication, copy (even partial) of any of the foregoing listed objects of intellectual property.

Limitations of use of the Site
and Services

The User agrees to use the Site and its services for private needs only. Use for commercial purposes is strictly prohibited.
Any content posted by the User is on his sole responsibility. The User agrees not to put on line any content that may have a negative impact on the interests of BE REAL PROPERTIES LTD and/or third parties, such as inappropriate content or likely to offend public order or morality.

Personal Data

1 - Personal data

The User is informed that the e-mail address he has communicated during the registration process will be stored and used by the Site for administration, management and animation of services purposes.
For accessing the Site and/or using “CONTACT US”, the User may be required to communicate personal information, the following:

• name and surname,

• email address,

• subject,

• message

Foregoing information are collected through different online forms.
“Cookies” may also be collected. Cookies collection can be switch off and/or deleted at any time by the User, however it could limit or prevent access to the Site or services.

2 - Purpose of collection

Collected information might be used for administration and management of the Site and of the services, and in particular:

• audience tracking and communication purposes,

• Newsletters,

• email campaigns,

• reply to User’s request for information,

• management and assessment of User’s application to a listing or service opportunities,

The Site strictly respects, and guarantees that its IT providers do as well, confidentiality of the personal information collected and to use it only for the foregoing purposes mentioned.
The Site guarantees that collection and processing of User’s personal information is carried out in strict compliance with the legal provisions enforceable regarding collection and storage of personal data.

All information published on the Site are from reliable source and have been carefully controlled and selected by BE REAL PROPERTIES LTD. However, no guarantee can be made and BE REAL PROPERTIES LTD may not be held responsible in this respect.
